4. THE SERVICES WE PROVIDE

4.4. Communication Tools

While we strive to provide a secure environment, Users are responsible for exercising caution and discretion in their communications. We do not monitor the content of private communications between Users, though we reserve the right to access and review such communications if reported or suspected of violating these Terms.

Homeowners may submit reviews and ratings for Professionals they have engaged through the Platform. Professionals may also, in some cases, provide feedback on Homeowners or projects. All reviews and feedback must be truthful, constructive, and based on actual experiences. We reserve the right to moderate, remove, or flag any reviews that violate our policies (e.g., are defamatory, offensive, or inaccurate). The integrity of our review system is paramount to maintaining the high standards of the Platform.

4.6. Content and Resources

5.3. Homeowner-Specific Obligations

  • Project Accuracy: Homeowners agree to provide clear, accurate, and comprehensive details for their Project Postings, including realistic budgets and timelines.
  • Property Access: Homeowners are responsible for ensuring safe and lawful access to their property for Professionals to perform services.
  • Due Diligence: Homeowners acknowledge and agree that it is their sole responsibility to research, interview, verify licenses, insurance, references, and credentials, and ultimately select the appropriate Professional for their project. luxury.jobsnesia.com explicitly disclaims any responsibility for the vetting or selection process.
  • Contractual Agreements: Homeowners are solely responsible for negotiating, entering into, and enforcing any contracts with Professionals.
  • Payments: Homeowners are responsible for timely and full payment for services rendered by Professionals, as per their separate agreements.

5.4. Prohibited Activities
You agree not to engage in any of the following prohibited activities:

All payments for services rendered by Professionals are handled directly between the Homeowner and the Professional, outside of the Platform. Users are solely responsible for negotiating payment terms, methods, and dispute resolution for project-related payments. We highly recommend that both Homeowners and Professionals use secure, verifiable payment methods and obtain formal, written agreements for all projects.

7.3. Billing and Payment Processing
For any fees due to luxury.jobsnesia.com (as per Section 7.1), you authorize us to charge your designated payment method (e.g., credit card, bank account) for all such fees. You represent and warrant that you are authorized to use the payment method designated. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms, suspend your access to the Services, or terminate your Account.

8. REVIEWS, RATINGS, AND FEEDBACK POLICY

WE DO NOT WARRANT OR GUARANTEE ANY SERVICES PERFORMED BY PROFESSIONALS FOR HOMEOWNERS, OR THE FINANCIAL TRANSACTIONS, QUALITY OF WORK, COMPLETION, OR ANY OUTCOME OF PROJECTS ARRANGED THROUGH THE PLATFORM. ALL RISKS ASSOCIATED WITH ENGAGING IN HOME IMPROVEMENT PROJECTS, INCLUDING PROPERTY DAMAGE, DELAYS, DEFECTIVE WORK, OR BREACH OF CONTRACT, REMAIN SOLELY WITH THE HOMEOWNER AND THE PROFESSIONAL.

10.5. Internet Security
luxury.jobsnesia.com DOES NOT WARRANT THAT THE PLATFORM, ITS SERVERS, OR EMAIL SENT FROM US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, COMMUNICATIONS, CONTENT, OR OTHER MATERIAL ACCESSED THROUGH OR OBTAINED BY MEANS OF THE PLATFORM.

  • ANY SERVICES PROVIDED BY PROFESSIONALS OR ANY AGREEMENTS BETWEEN HOMEOWNERS AND PROFESSIONALS;
  • ANY DAMAGE TO YOUR PROPERTY OR PERSON ARISING OUT OF THE PROVISION OF SERVICES BY A PROFESSIONAL;
  • ANY FAILURE OR DELAY IN THE PERFORMANCE OF A PROFESSIONAL’S SERVICES; OR
  • ANY OTHER MATTER RELATING TO THE PLATFORM.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF luxury.jobsnesia.com, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS TO YOU FOR ALL CLAIMS RELATING TO THE PLATFORM EXCEED THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO luxury.jobsnesia.com IN THE LAST THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. INDEMNIFICATION

13. TERM AND TERMINATION

13.3. Termination by luxury.jobsnesia.com
luxury.jobsnesia.com reserves the right, in its sole discretion, to suspend or terminate your Account and deny access to all or part of the Platform for any reason, including, without limitation, for breach of these Terms, for lack of use (e.g., if you fail to log in for an extended period), or if we believe your conduct is harmful to other Users, third parties, or the business interests of luxury.jobsnesia.com. We may do so without prior notice.

13.4. Effects of Termination
Upon termination of your Account or access to the Platform for any reason:

YOU AGREE THAT ALL CLAIMS YOU MAY HAVE AGAINST luxury.jobsnesia.com WILL BE BROUGHT INDIVIDUALLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. BY USING THE PLATFORM, YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.
